Terms of Service
Effective date: August 27, 2026
These Terms are between you and Eagle Aviation Columbia, LLC, doing business as AERO. By creating an account, accepting these Terms, or using AERO, you agree to them. If you use AERO for an organization, you represent that you may bind it. You must be at least 13; if local law requires parental consent or a higher age to enter these Terms, you may use AERO only with that authorization.
The Service And Accounts
AERO provides aviation discovery, directory, map, marketplace, communication, profile, review, trip, arrival-intelligence, advertising, and AI-assisted features. Features may change, be unavailable, or be offered as beta functionality. Keep account information accurate, protect credentials, and promptly report unauthorized use. Clerk provides authentication, but you remain responsible for activity under your account.
User Content And Marketplace Interactions
You retain ownership of content you submit. You grant AERO a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, transmit, and otherwise use that content only as needed to operate, improve, secure, and promote the service and as directed by your settings. You represent that you have necessary rights and that tail history, reviews, uploads, messages, and listings are accurate and lawful.
AERO may connect users with independent facilities and providers but is not a party to their services unless expressly stated. Providers control availability, pricing, performance, and their own data practices. Resolve quote, fulfillment, and service issues with the applicable provider, while AERO may assist at its discretion.
Aviation And AI Caution
AERO is not an official aeronautical-information source. Airport, facility, fuel, weather, NOTAM, FAA/NASR/ADIP, map, and other public or third-party information may be delayed, incomplete, or wrong. AERO and AERO Assist are not operational flight-planning tools and do not provide safety, legal, maintenance, or air-traffic advice. AI output can be inaccurate or fabricated. Pilots, dispatchers, operators, and other users must independently review output and verify current authoritative sources, applicable publications, and qualified human guidance before acting.
Acceptable Use
You must follow the Acceptable Use Policy. Do not break laws; endanger aviation operations; impersonate others; submit fraudulent requests or reviews; scrape, probe, disrupt, reverse engineer, or bypass controls; upload infringing or harmful material; harvest personal information; send spam; or use AERO or its data to train competing models or services without written permission. We may remove content, rate-limit, suspend, or terminate access where reasonably necessary to protect AERO, users, providers, or the public.
Paid Plans, Renewal, Cancellation, And Refunds
Stripe processes paid plans. Displayed checkout terms identify price and billing interval. Unless checkout says otherwise, subscriptions renew automatically until canceled. You authorize recurring charges and are responsible for applicable taxes. Cancel through the available billing controls before renewal to avoid the next charge. Cancellation normally takes effect at the end of the paid period. Fees are generally non-refundable and no credits are provided for partial periods, except where required by law or expressly stated in writing. Price or plan changes will receive notice as required by law.
Intellectual Property And Feedback
AERO software, designs, brands, compilations, and original content are owned by AERO or licensors. These Terms grant a limited, revocable, non-transferable right to use the service for its intended purpose. Public-source data remains subject to source terms. Feedback may be used without restriction or compensation, but AERO does not acquire ownership of unrelated user content.
Privacy, Communications, And Third Parties
The Privacy Policy describes personal-information practices. You may receive transactional messages and opted-in marketing; carrier rates may apply to SMS. Manage available preferences, although essential account, safety, billing, and legal notices may continue. Third-party services and external links are governed by their own terms.
Disclaimers
To the extent permitted by law, AERO is provided "as is" and "as available." AERO does not warrant uninterrupted availability, accuracy, fitness for a particular purpose, provider performance, or that every defect or harmful component will be detected. Statutory warranties that cannot be excluded remain unaffected.
Liability
To the extent permitted by law, AERO and its affiliates will not be liable for indirect, incidental, special, exemplary, or consequential damages, lost profits, lost data, or aviation or operational decisions arising from the service. AERO's aggregate liability arising from the service will not exceed the greater of US $100 or fees you paid AERO in the 12 months before the event giving rise to the claim. These limits do not apply where prohibited or to liability that cannot lawfully be limited.
Suspension, Termination, And Changes
You may stop using AERO and request deletion. AERO may suspend or terminate access for material breach, unlawful conduct, security risk, nonpayment, or harm, with notice and an opportunity to cure where reasonable and legally required. Provisions intended by nature to survive will survive. We may update these Terms and will post an effective date and provide additional notice or obtain renewed acceptance for material changes when appropriate.
Governing Law And Disputes — Attorney Review Required
South Carolina law governs these Terms without regard to conflict-of-law rules, except mandatory consumer protections in your jurisdiction.
ATTORNEY REVIEW REQUIRED BEFORE PRODUCTION RELIANCE: The parties have intentionally not specified binding arbitration, exclusive venue, a final court forum, class-action waiver, or a detailed pre-suit dispute process in this implementation-informed template. Qualified counsel must complete and approve the dispute-resolution language. Nothing here limits non-waivable consumer rights.
